EO Program Policy Development
The EO Program Policy Development function within PPE develops policies and procedures under a host of EO mandates. Some examples of EO mandates and the ODEO policy development undertaken pursuant to them include:
EEO/Anti-Harassment
Title VII of the Civil Rights Act of 1964 prohibits discrimination in employment based on race, color, national origin, sex, and religion.
Under Title VII, ODEO develops Agency policy on matters such as EEO and anti-harassment.
Gender Non-Discrimination in NASA-Funded Science, Technology, Engineering, and Mathematics (STEM) Programs
Title IX of the Education Amendments of 1972 prohibits exclusion from participation in, denial of the benefits of, or discrimination on the basis of sex in any education program or activity receiving Federal financial assistance.
Under Title IX and related laws, such as Title VI of the Civil Rights Act of 1964, ODEO develops policy and procedures for conducting compliance reviews of NASA-funded programs.
Information/Electronic Technology Accessibility for Individuals with Disabilities
Section 508 of the Rehabilitation Act of 1973 requires Federal agencies to ensure that individuals with disabilities have access to and use of information and data that is comparable to the access and use of the information by members of the public who are not individuals with disabilities.
Under Section 508, ODEO has developed policy and procedures for filing complaints regarding comparable access for individuals with disabilities to NASA electronic and information technology.
Limited English Proficiency
Executive Order 13166 requires Federal agencies to ensure meaningful access to Federal programs for limited English proficient (LEP) persons.
Under Executive Order 13166, ODEO has developed guidance to grant recipients to ensure meaningful access to NASA funded programs, and a Language Assistance Plan and other guidance for NASA-conducted programs serving LEP persons.
Reasonable Accommodations for NASA Employees/Applicants with Disabilities
Executive Order 13164 requires Federal Agencies to establish procedures to facilitate the provision of reasonable accommodation.
Under this Executive Order, ODEO has issued policy and procedures to ensure the provision of reasonable accommodations to qualified employees and applicants for NASA employment.
Sexual Orientation Non-discrimination
Executive Order 13087 makes it the policy of the Federal government to provide equal opportunity in Federal employment and to prohibit discrimination based on sexual orientation. Consistent with this executive order, it is NASA policy to provide EEO for all employees or applicants regardless of their sexual orientation.
The Civil Service Reform Act of 1978 (CSRA), as amended, prohibits federal employees who have authority to take, direct others to take, recommend or approve any personnel action from discriminating against an applicant or employee on the basis of conduct which does not adversely affect the performance of the applicant or employee. The Office of Personnel Management (OPM) has interpreted the CSRA prohibition of discrimination based on "conduct" to include discrimination based on sexual orientation. OPM has issued guidelines on sexual orientation discrimination and the U.S. Equal Employment Opportunity Commission has issued a fact sheet providing information on sexual orientation discrimination.
The NASA Administrative Grievance Procedures may be used by NASA employees who are not in an exclusive bargaining unit to file a grievance of discrimination based on sexual orientation. Employees who are members of an exclusive bargaining unit with a negotiated grievance procedure may use that negotiated grievance procedure to file a grievance of discrimination based on sexual orientation.
Under Executive Order 13160, an individual may file a complaint of discrimination regarding NASA conducted education and training programs and activities based on a number of protected classifications, including sexual orientation.
