Investigations, Hearings, Alternative Dispute Resolution

 
 

This functional unit conducts all equal employment opportunity (EEO) investigations. In addition, it implements policy and formulates training and technical guidance for ADR programs. Provides EEO Counseling at the informal stage for aggrieved employees, and applicants.

This unit maintains oversight responsibility for conducting investigations, which includes development of an impartial and appropriate factual record.  Additionally, it monitors settlement agreements to ensure Agency compliance and tracks compliance of orders issued by the Equal Employment Opportunity Commission (EEOC).

Title VII of the Civil Rights Act of 1964 prohibits discrimination in employment based on race, color, national origin, sex, and religion;

Administrative Dispute Resolution Act of 1996 (ADR Act) requires each federal agency to adopt a policy on ADR use. ADR is a process in which a third party neutral assists the disputants in reaching an amicable resolution through the use of various techniques. ADR describes a variety of approaches to resolve conflict which avoid the cost, delay, and unpredictability of the traditional adjudicatory processes while at the same time improving workplace communication and morale;

Equal Employment Opportunity Management Directive (MD-110) is a directive to provide federal agencies with the EEOC’s policies, procedures, and guidance on proper procedures for investigation and hearings.  Additionally, provides insight for utilizing ADR and developing ADR programs.

Title 29 Code of Federal Regulations Part 1614 – Federal Sector Equal Employment Opportunity mandates that each Agency conducts ADR and develops an impartial and appropriate factual record during the investigation.
