Title VI/Title IX Program
Equal Opportunity in federally assisted and conducted programs is protected under Title VI of the Civil Rights Act of 1964, Title IX of the Education Amendments of 1972 and related laws and authorities. The objective of this Program is to enforce Federal civil rights laws
prohibiting discrimination in NASA assisted and conducted programs and
activities.
Background
In 1964, Congress passed the most sweeping civil rights legislation the country
had seen in nearly a century. The Civil Rights Act of 1964 prohibited
discrimination in, among other areas, public accommodations (Title II),
employment (Title VII), and programs and activities receiving Federal financial
assistance (Title VI). The Federal government provides financial assistance in
the form of grants, property, and other resources to a wide range of recipients
including school districts, colleges and universities, police departments,
non-profit organizations, and many other entities.
Title VI of the Act prohibited discrimination on the basis of race, color, and
national origin. During the decade after passage of the Civil Rights Act,
Congress passed a series of laws extending civil rights protections in Federally
assisted programs and activities. These laws, modeled on Title VI, prohibited
discrimination on the basis of sex in Federally assisted education programs
(Title IX of the Education Amendments of 1972), disability in Federally assisted
and conducted programs (Section 504 of the Rehabilitation Act of 1973), and age
in Federally assisted programs (the Age Discrimination Act of 1975). (see also "Additional Information")
More recently, in June 2000, the White House issued Executive Order 13160,
prohibiting discrimination in Federally conducted education and training
programs on the bases of race, color, national origin, sex, disability, age,
religion, parental status and sexual orientation. Executive Order 13160 is
administered through a complaints processing system similar to that NASA has
developed for complaints filed pursuant to the other authorities referred to
above (see also "Additional Information").
In August 2000, the White House issued Executive Order 13166, requiring that
Federal Agencies undertake proactive efforts to ensure meaningful access to
federally funded programs for persons with Limited English Proficiency (LEP).
NASA has implemented the requirements of this Executive Order through a number
of means, including Policy Guidance to grant recipients of NASA financial
assistance and Agency and Center Language Assistance Plans (see also "Additional Information")
NASA's Role and Responsibilities
NASA, as a Federal agency providing over 1.3 billion dollars a year in
financial assistance to a variety of recipients including colleges and
universities, non-profit organizations, and private corporations, is obligated
to ensure against illegal discrimination in all of the programs and activities
the Agency assists financially. Therefore, NASA's Title VI Program encompasses
the Agency's efforts to ensure compliance with the nondiscrimination mandates
of:
- Title VI of the Civil Rights Act of 1964
- Title IX of the Education Amendments Act of 1972
- Sections 504 and 508 of the Rehabilitation Act of 1973
- The Age Discrimination Act of 1975
- Executive Order 13160, June 23, 2000
- Executive Order 13166, August 11, 2000
The program operates pursuant to both external and NASA regulations and
policy guidance, including:
- 28 CFR 50.3, Guidelines for the Enforcement of Title VI, Civil Rights Act
of 1964.
- 28 CFR Part 42, Subpart F, Coordination of Enforcement of Nondiscrimination
in Federally Assisted Programs.
- 14 CFR Parts 1250-1253, Nondiscrimination in Federally-Assisted Programs of
NASA - Effectuation of Title VI of the Civil Rights Act of 1964 (Part 1250);
Nondiscrimination on Basis of Handicap (Part 1251); Nondiscrimination on the
Basis of Age in Programs and Activities Receiving Federal Financial Assistance
(Part 1252); Nondiscrimination on the Basis of Sex in Education Programs or
Activities Receiving Federal Financial Assistance (Part 1253).

Pursuant to these authorities, NASA, as a Title VI enforcement agency, is
required to:
- Publish Agency regulations and/or policy guidance.
- Establish, in published guidelines, procedures for the prompt processing and
disposition of complaints; such procedures should include detailed instructions
on complaints intake, counseling, referral, investigation, and reporting
requirements.
- Conduct a program of postaward compliance reviews of the Agency's recipients
of Federal financial assistance.
- Prepare and disseminate outreach and information materials providing contact
information and ensuring that each recipient makes this information available to
its beneficiaries.
- Prepare annual and other reports for DOJ on activities relating to these
authorities.
