SAFETY AND HEALTH PLANS IN SEALED BID PROCUREMENTS
PURPOSE: To provide for submission of Safety and Health Plans after selection of the successful offeror in sealed bid acquisitions.
BACKGROUND: Procurement Notice 97-46, Risk Management, eliminated the previous Alternate I to clause 1852.223-73, Safety and Health Plan. This alternate allowed the submission of a Safety and Health Plan after selection of the successful offeror but before award.
GUIDANCE: Submission of the Safety and Health Plan with the bid in a sealed bid action is often impractical, especially in construction contracting. Therefore, the following Alternate I will be added for sealed bidding purposes only, when the final rule for this material is published. Until then, contracting officers are authorized to use the following Alternate I to 1852.223-73, in sealed bid procurement actions:
In Invitations for Bids, delete the first sentence of the basic provision and substitute the following:
The apparently successful offeror shall submit a detailed safety and occupational health plan (see NPG 8715.3, NASA Safety Manual, Appendix H) after notification of selection but before award.
EFFECTIVE DATE: This PIC is effective as dated and shall remain in effect until cancelled or superseded.
