CANCELLATION OF PIC 99-12 AND PIC 00-26
PURPOSE: To cancel PIC 99-12 and PIC 00-26.
BACKGROUND: PIC 99-12 was issued on July 2, 1999, to provide a FAR deviation to implement the statutory change at Section 1354 of Public Law 105-339, Veterans Employment Opportunities Act of 1998. The statutory change prohibited an agency from obligating or expending appropriated funds on a contract with a contractor that was required to submit an annual Form VETS-100, Federal Contractor Veterans’ Employment Report (VETS-100 Report) for the preceding fiscal year if the contractor did not submit the report. The change also increased the threshold for covered contracts from $10,000 to $25,000. Item IV of FAC 01-01 incorporates these statutory changes.
PIC 00-26 was issued on December 20, 2000, to provide a FAR deviation to implement Section 1010 of the National Defense Authorization Act for Fiscal Year 2001 (Public Law 106-398), which imposed a statutory requirement on agencies to pay an interest penalty on interim payments that are made late under cost-reimbursement service contracts. Item III of FAC 01-01 incorporates this statutory requirement by adding new policy and a contract clause, Alternate I to 52.232-25, to provide for these penalty payments.
GUIDANCE: PIC 99-12 and PIC 00-26 are canceled, and contracting officers must comply with FAC 01-01.
CANCELATION: This PIC cancels PIC 99-12 and PIC 00-26.
EFFECTIVE DATE: This PIC is effective as dated and shall remain in effect until January 30, 2002.
