REPORTING SOLE SOURCE PROCUREMENTS TO HQ
PURPOSE: To require procurement offices to notify Headquarters Office of Procurement (Program Operations Division) when sole source contract awards or modifications are planned that are not being synopsized on the Federal Business Opportunities website.
BACKGROUND: The FY 2005 Omnibus Appropriations Conference Report directed NASA to notify the House and Senate Appropriations Committees of NASA’s intent to enter into a sole source contract exceeding $500K (including options). The Committees are also to be notified of all sole source contract modifications exceeding $500K that require a JOFOC. Subsequently, the Office of Management and Budget (OMB) directed NASA to provide similar information to them.
The NAIS software was recently modified to capture synopses of NASA sole source contract actions that are posted on the Federal Business Opportunities website. That data is being reported by the software to the HQ Program Operations Division where it is reviewed and reported to the Hill and OMB as applicable. However, a small number of contract actions to which the reporting requirement applies are not synopsized. Those actions will need to be reported by the Center procurement office to the HQ Program Operations Division.
This PIC provides guidance on how to manually report sole source contract actions that exceed $500K and that are not synopsized.
GUIDANCE: This guidance applies to all sole source contract awards exceeding $500K (including options) and sole source contract modifications that exceed $500K and require a JOFOC when such contract awards and modifications will not be synopsized, in accordance with FAR Subpart 5.202, Exceptions. Contracting officers shall report those actions to the Headquarters Program Operations Division in the Office of Procurement, attention: Anne Guenther, at firstname.lastname@example.org, and Yolande Harden, at email@example.com.
The report shall be made as soon as the action is identified in the procurement office and prior to release of the solicitation either to the prospective offeror or incumbent contractor. It shall consist of the following information:
- Description of procurement
- Expected date of contract award or modification issuance
- Current estimated value (including options)
- Point of contact name and phone number for follow-up questions
Centers are not required to submit information on awards covered under this PIC, which were made between October 1, 2004, and the effective date of this PIC.
EFFECTIVE DATE: This PIC is effective as dated and shall remain in effect until canceled or superseded.
