REPORTING SOLE SOURCE PROCUREMENTS TO HQ
PURPOSE: To revise PIC 05-04 that required procurement offices to notify Headquarters Office of Procurement (Procurement Operations Division) when sole source contract awards or modifications are planned that are not being synopsized on the Federal Business Opportunities website. This revision clarifies that this reporting requirement also applies to sole source acquisitions made under Federal Supply Schedules. The reporting does not apply to Interagency Acquisitions under the Economy Act.
BACKGROUND: The FY 2005 Omnibus Appropriations Conference Report directed NASA to notify the House and Senate Appropriations Committees of NASA’s intent to enter into a sole source contract exceeding $500K (including options). The Committees are also to be notified of all new work sole source contract modifications exceeding $500K that require a JOFOC per FAR Part 6 or a Sole Source Justification per FAR Part 13. Subsequently, the Office of Management and Budget (OMB) directed NASA to provide similar information to them.
The NAIS software was recently modified to capture synopses of NASA sole source contract actions that are posted on the Federal Business Opportunities website. That data is being reported by the software to the HQ Program Operations Division where it is reviewed and reported to the Hill and OMB as applicable. However, a small number of contract actions to which the reporting requirement applies are not synopsized. Those actions will need to be reported by the Center procurement office to the HQ Procurement Operations Division.
This PIC provides guidance on how to manually report sole source new procurement actions that exceed $500K and that are not synopsized. For purposes of this reporting requirement, “sole source” should be interpreted to mean that only one source will be solicited.
GUIDANCE: This guidance applies to all sole source new procurement actions, made by award or modification, exceeding $500K (including options) where, for whatever reason, such contract awards and modifications will not be synopsized. This requirement does not apply to Interagency Acquisitions under the Economy Act. Contracting officers shall report such actions to the Headquarters Program Operations Division in the Office of Procurement, attention: Sheryl Goddard, at firstname.lastname@example.org, and Diane Frazier, at: email@example.com.
The report shall be made as soon as the JOFOC or Sole Source Justification for an action is approved and prior to release of the solicitation either to the prospective offeror or incumbent contractor. It shall consist of the following information:
- Description of procurement
- Expected date of contract award or modification issuance
- Current estimated value (including options)
- Point of contact name and phone number for follow-up questions
EFFECTIVE DATE: This PIC is effective as dated and shall remain in effect until canceled or superseded.
CANCELLATION: PIC 05-04 is cancelled.
