CANCELLATION OF VARIOUS PICs RELATED TO SMALL
BUSINESS POLICY AND SMALL BUSINESS SIZE REPRESENTATIONS
PURPOSE: To cancel various Procurement Information Circulars (PICs) related to
small business policy and small business size representation. Substantive information contained in these
PICs still relevant to NASA acquisition is being incorporated into the NASA FAR
Supplement or other procurement-related guidance as set forth below.
BACKGROUND: The Office of Procurement and Office
of Small Business reviewed the existing PICs on small business, cancelling many
old circulars after ensuring certain requirements were included in the NFS via
PN 04-33. The following PICs are hereby
cancelled:
- 98-1
Termination of 8(a) Contracts, dated January 14, 1998. Section 1819.812(d) is being added to
the NFS to require Contracting Officers coordinate any planned requests
for waiver of an 8(a) contract termination with the Headquarters Office of
Procurement (Program Operations Division) prior to submitting a
notification of a request for waiver to the Small Business Administration.

Specifying Subcontracting Goals in Solicitations, dated June 28, 1999. Section 1815.304(c)(4)(B) of the NFS is being revised to
provide that when proposed small business goals are evaluated under
competitive negotiated acquisitions,
the proposed Small Disadvantaged subcontracting goal shall not be
discretely evaluated, but should be included in the evaluation of the
cumulative goal for all the small business categories identified in the
plan when proposed small business goals are evaluated under competitive
negotiated acquisitions. Further,
section 1815.304(c)(4)(C) of
the NFS will provide guidance that solicitations should not contain
suggested goals for the evaluation of SDB participation. Proposed SDB
participation levels shall be evaluated based on a standard of
reasonableness relative to the offeror’s proposed effort.

Reporting HUBZone Contracts to the Federal Procurement Data System, dated
July 15, 2002. Section
1804.601(d)(1) is being added to the NFS to clarify that only actions
awarded to SBA certified HUBZone small businesses are to be counted
towards HUBZone goal achievement when reporting information in the Federal
Procurement Data System (FPDS).

cancelled PICs are:

Subcontracting Opportunities in Small Business Set-Asides, dated January
23rd, 2002. Guidance
in the PIC states that Contracting Officers may develop solicitation
language for small business set-asides which provides historical data on
previous subcontracting opportunities for similar effort as it relates to
the implementation of FAR 52.219-8, Utilization of Small Business
Concerns. This guidance will be
incorporated into the next revision of NASA’s Source Selection Guide for
Source Evaluation Boards (June 2007).

Socio-Economic Goaling Process, dated February 6, 2003. Guidance in the PIC sets forth the
process used to establish Center specific socio-economic goals as
percentages of contract expenditures.
Updated guidance is provided annually to Centers by the NASA Office
of Small Business Programs on the specific process to be used to establish
the annual goals. This guidance
supersedes the PIC.

Small Business Size Rerepresentations, dated July 2, 2007. A
modification to the Federal Procurement Data System (FPDS) to allow contracting
officers to enter size status changes without corrupting past entries has
been completed. This ensures that
size achievements prior to re-representation are preserved.
- 07-08
Small Business Size Rerepresentation Requirements for Existing Contracts,
dated August 31, 2007. The PIC
was a one time only reminder to clarify the requirements of Federal
Acquisition Circular 2005-18, dated July 5, 2007; therefore the guidance
concerning existing contracts is no longer required.
CANCELLATION: PIC 98-1, 99-11, 02-01, 02-13, 03-05,
07-06, and 07-08 are cancelled.
EFFECTIVE DATE: This PIC is effective as dated and shall remain in effect until May 30,
2008.
