CLASS DEVIATION FIVE YEAR TERM OF CONTRACT

PERIOD OF PERFORMANCE EXTENSIONS FOR CENTER PROTECTIVE SERVICES CONTRACTS

 

PURPOSE:  To provide an extension of the previous class deviation from the requirements of Federal Acquisition Regulation (FAR) 17.204(e) and NASA FAR Supplement (NFS) 1817.204(e)(iii).  This class deviation applies only to existing contracts with requirements that would have migrated to the canceled NASA Protective Services Contract (NPSC).  

 

BACKGROUND:  FAR 17.204(e) and NFS 1817.204(e)(iii) limit the terms of service contracts to five (5) years including the basic contract and all options. 

 

On September 13, 2010, NASA canceled the NPSC acquisition which would have provided consolidated protective services on an Agency-wide basis. NASA canceled the NPSC contract for two primary reasons:

 

  1. The operational environment facing NASA changed, thus eroding much of the initial rationale for consolidating protective service requirements.
  2. NASA would like to improve small business participation agency-wide. Prior to NPSC, NASA awarded 16 out of 18 protective service contracts to small businesses.

 

NASA intends to use center-level procurements to adapt to the changing operational environment and contribute to small business goals.

 

Since NASA centers have only recently commenced acquisition planning for follow-on protective service contracts, NASA must maintain continuity of service by extending the period of performance for several existing protective services contracts.  In some cases, the extensions will cause existing contracts to exceed the five year maximum period of performance. These extensions are necessary in order to complete center-level competitions.

 

GUIDANCE:  A class deviation from FAR 17.204(e) and NFS 1817.204(e)(iii) is hereby provided to authorize contracting officers, with the approval of the procurement officer, to extend the period of performance on existing contracts with requirements that would have migrated to the canceled NASA Protective Services Contract (NPSC).

 

Contracting Officers are authorized to extend these contracts through December 31, 2011. 

 

Extensions beyond the period described in this deviation must be supported by an additional deviation and approved by the Assistant Administrator for Procurement.

 

 

Other regulatory requirements, such as synopsis, JOFOC, etc., are still applicable.

 

EFFECTIVE DATE:  This PIC is effective as dated and shall remain in effect until the center awards all of its protective service procurements.
