SET-ASIDES UNDER THE SMALL
PURPOSE: To institute or continue small business set-asides under the Small Business Competitiveness Demonstration Program.
BACKGROUND: The Small Business Competitiveness Demonstration Program requires NASA to use full and open competition for all solicitations in each of four designated industry groups (DIGs) if the anticipated award value exceeds the emerging small business (ESB) reserve amount. The DIGs are: construction; A&E services; refuse systems and related services; and east coast and west coast non-nuclear ship repair. The ESB reserve amount is $50,000 for A&E services and $25,000 for the other DIGs.
Small business set-asides must be reinstated for solicitations above the ESB reserve amount when an annual Agency review shows that small businesses have not received -
1. Forty percent of dollar awards in a DIG;
2. Thirty five percent of dollar awards for any individual FPDS service code within the A&E services industry group even if overall goal attainment in the industry group is 40 percent; or
3. Thirty five percent of dollar awards for any individual SIC code within one of the major groups comprising the construction industry group even if overall goal attainment in the major group is 40 percent.
Set-asides apply only at those centers that have not met the applicable percentages, and the full and open competition requirement is resumed once the annual Agency review determines that the percentages have been achieved.
GUIDANCE: The annual review for the period ending September 30, 1999, indicated that NASA did not meet its 40 percent goals for the A&E and construction DIGs. Accordingly, the indicated centers must use small business set-asides for solicitations expected to exceed the ESB reserve amount in the following construction SIC codes and A&E FPDS service codes. If acquisitions cannot be set aside as required, the contract file shall contain a written justification concurred in by the procurement officer. Please note that these set-aside requirements do not apply to acquisitions reserved for emerging small businesses, 8(a) awards, or sole source awards.
1. A&E requirements in the following Product/Service Codes (PSC) under SIC codes 8711, 8712, and 8713 at the listed centers:
a. PSC C119 at Ames Research Center, Kennedy Space Center, and Marshall Space Flight Center.
b. PSC C211 at Ames Research Center and Stennis Space Center.
c. PSC C213 at Johnson Space Center.
d. PSC C215 at Ames Research Center.
e. PSC C219 at the Headquarters Operations Office at Goddard Space Flight Center, Langley Research Center, and Marshall Space Flight Center.
2. Construction requirements in the following SIC codes at the listed centers:
a. SIC code 1721 (Painting and Paper Hanging) at Ames Research Center.
b. SIC code 1731 (Electrical Work) at Ames Research Center, Glenn Research Center, and Goddard Space Flight Center (including Headquarters Operations).
c. SIC code 1742 (Plastering, Drywall, Acoustical and Insulation Work) at the Headquarters Operations Office at Goddard Space Flight Center.
d. SIC code 1771 (Concrete Work) at Kennedy Space Center.
e. SIC code 1799 (Special Trade Contractors, N.E.C.) at Ames Research Center.
CANCELLATION: This PIC supersedes PIC 99-14, dated July 21, 1999.
EFFECTIVE DATE: This PIC is effective as dated and automatically expires December 31, 2000, unless extended, superseded or canceled.
